Under Minnesota law, at what Blood Alcohol Concentration (BAC) is an adult driver aged twenty-one or older considered legally intoxicated?
The answer
Answer: A. Under Minnesota traffic statutes, a person with a Blood Alcohol Concentration of 0.08 percent or higher is legally intoxicated and may be convicted of Driving While Impaired (DWI). However, a driver can be arrested and convicted of DWI at any alcohol level if law enforcement proves their driving ability was impaired.
